By using the SPARX3D Website, you acknowledge that you have read, understood, and agree to be bound by these “Terms and Conditions” and to comply with all applicable laws and regulations. If you do not agree with these Terms and Conditions, you should not use the SPARX3D Services and Website.

SPARX3D Services

SPARX3D Services encompass a range of offerings provided through the Website, including but not limited to:

1. 3D Printing Services: Enabling you to upload a 3D file to our Website or email it, and place an order to have it manufactured. At a charge of a service price and the price for the materials used for the model, we will manufacture the model for you using our materials and ship it to you.
2. 3D Designing Services: Providing professional 3D design services to create or modify 3D models according to your specifications.
3. PCB Designing Services: Offering printed circuit board (PCB) design services to create custom PCBs based on your requirements.
4. Research and Product Development Services: Conducting research and providing product development support to help bring your ideas to life.

Ordering

• Placing an Order: To order a 3D model or any service, upload your design or provide requirements via email, select the service, and submit your request. We will send a quotation. Upon approval and advance payment, we will proceed. Complete the payment to receive the final product or service.
• Order Cancellation by SPARX3D: We reserve the right to cancel your order at any stage due to feasibility issues, legal concerns, delivery destination, or end use of the product. If we cancel your order, we will notify you via email and issue a full refund at our discretion.
• Payment and Pricing: Prices include the service fee and material costs, as well as shipping and sales tax (if applicable), but exclude import duties or taxes. All prices are in Indian Rupees (INR).
• Order Acceptance: Upon accepting your order, we will send a confirmation email. If we cannot accept your order, we will notify you via email. Verify details in the confirmation email and report errors to admin@sparx3d.com as soon as possible.
• Shipping: We will ship to your provided address within the estimated delivery time. Shipping dates are estimates; we are not liable for delays. Title and risk transfer to you upon handing over to the carrier.
• Cancellation of your order, return of models: Due to the personalized nature of our Services (i.e., the model or service is supplied by us based on your specifications), you cannot cancel your order after it goes into production or the service has commenced. Additionally, we are not able to refund purchases of a “Gift Card” or a “Material Sample Kit Basic (with free Gift card)” at any point. Orders that contain non-refundable items are still cancellable; however, note that a refund or cancellation will not apply to items in the order that are non-refundable.

Warranty

SPARX3D warrants that the manufactured models will substantially meet the features of the indicated 3D model within the limitations of 3D printing technology. For other services, we ensure reasonable care and skill. We do not guarantee that models, designs, PCBs, or research outcomes will be fit for any specific purpose. Inspect the model or deliverables immediately upon receipt. Report any faults within 7 days to admin@sparx3d.com. Do not return items unless instructed.

SPARX3D provides the Website and Services “as is” and “as available.” We do not guarantee uninterrupted or error-free use.

SPARX3D DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Use Of Website

All content on the Website, including software, audio, video, text, and photographs (excluding User Generated Content), is owned by SPARX3D or its licensors. Content may be reproduced for personal, non-commercial use only. Any other use requires prior written consent from SPARX3D.
SPARX3D is not responsible for third-party website content linked from our site. Expect occasional downtime for updates. We strive for reliability but do not guarantee uninterrupted service.

User Generated Content

“User Generated Content” includes all content uploaded by you, such as 3D designs, photos, comments, and specifications. Content must not be abusive, harassing, defamatory, obscene, fraudulent, deceptive, offensive, pornographic, illegal, or infringing on intellectual property rights.

SPARX3D is not obligated to review User Generated Content and is not responsible for it. Opinions in User Generated Content do not reflect SPARX3D’s views.

By submitting User Generated Content, you grant SPARX3D a worldwide, non-exclusive, royalty-free license to use, modify, reproduce, distribute, and display the content. You also grant other users a license to access and use your content. This license does not affect your ownership rights.

You warrant that you have the right to grant these licenses and that your content does not infringe on any rights or laws. We reserve the right to remove any User Generated Content at any time.

Refund Policy

Returns
Our store policy lasts 7 days from the date of purchase. If 7 days have gone by since your purchase, unfortunately, we can’t offer you a refund or exchange under any circumstance.
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Non-returnable items include 3D Printed parts, 3D filaments, 3D Printers, scanners, 3D Printer Parts, and support items.
To complete your return, we require a receipt or proof of purchase (Order No & Order Date). Any damage incurred to the items while returning them for replacement or exchange must be borne by the sender.

Refunds
Processed within 14 days of approval. Contact us if you have not received your refund.

Shipping Costs
You cover return shipping costs. We don’t guarantee that we will receive your returned item unless a tracking ID is supplied to us for the return item once dispatched.

Limitation Of Liability

These terms outline the extent of our obligations and liabilities. We do not offer any warranties, conditions, or terms beyond those expressly stated. SPARX3D is not liable for any loss of income, profits, contracts, data, or any indirect or consequential loss or damage. Our maximum liability is the amount you paid for the product(s) in question.

Indemnification

You agree to indemnify SPARX3D and its affiliates, officers, directors, agents, employees, and suppliers against all claims, costs, liabilities, losses, and damages (including legal fees) arising from your breach of these Terms and Conditions, your violation of any law, or your misuse of the Website and Services.

We reserve the right to modify these Terms and Conditions or any policy of the Website and Services at any time. We will notify you by posting a notice on the Website. Your continued use of the Website and Services indicates acceptance of these changes.
